Can A Biden Executive Order Take Away Your Guns?

The White House is trying to craft a series of executive actions for President Joe Biden to sign aimed at curbing gun violence on Thursday, in the aftermath of the mass shootings in Atlanta and Boulder.

When asked about a gun control executive order at a press conference on March 26, 2021, the president responded, “Well, we’re looking at that right now.”

We’re looking at what kind of authority I have relative to imported weapons, as well as whether or not I have any authority to—these new weapons that are being made by 3D equipment that aren’t registered as guns at all, there may be some latitude there as well,” he added.

According to the US Bureau of Alcohol, Tobacco, Firearms and Explosives, more than 30% of the illegal weapons it has confiscated in some areas of California are ghost guns.

Moreover, the president also is expected to announce his nomination of David Chipman as the director of the Justice Department’s Bureau of Alcohol, Tobacco, Firearms and Explosives, according to senior administration officials.
It is to be remembered that the US President has the ability to issue executive orders. In fact, executive orders can be traced all the way back to this country’s first President, George Washington.

An executive order is a means of issuing federal directives by the President to manage the operations of the federal government.

The legal or constitutional basis for executive orders has multiple sources.
